- 1.Subject

1.1. Subject of the Agreement is providing of the service
of internet-telephony by the equipment of telematic divisions of the
delivery of voice information of the Performer over the channels of data
reporting with packet switching.
|
|
|
- 2. Terms of the Agreement
|
|
|
2.1. After conclusion of the present Agreement, the Customer has access
to the installation and adjustment of the software of PCTEL. |
|
2.2. The Performer doesn’t guarantee the continuous and faultless providing
of the service. The Performer reserves the right to suspend the service
at any time for the preventive measures or error elimination. The Performer
is obliged to recover the service as soon as possible. |
|
2.3. The Performer reserves the right to change prices and conditions
of the present Agreement. The Performer notifies the Customer about
changes of the prices at the website. |
|
2.4. If the Customer doesn’t employ the service of the Performer during
6 months and more, the Performer has the right to close the account
of the Customer without compensation of the remaining credit. |
|
2.5. Before the conclusion of the present Agreement, the Customer is
obliged to perform the positive test call (to establish the connection)
within the network PCTEL. |
|
2.6. The Customer has the right to get into touch with the Performer
by e-mail, indicated at the website, at any time. |
|
2.7. The Customer is obliged not to use the service for the purposes,
which may cause direct or indirect damage to the third parties. Including:
terrorism, illegal financial operations, actions, which cause fomentation
of ethnic, religious and other strife. |
|
2.8. The Performer doesn’t provide the access to the extreme services
to the Customer. |
|
2.9. In case of impossibility of using of the service by the Customer
through the Performer’s fault during 10 days and more, the Customer
has the right to cancel the present Agreement unilaterally, upon condition
of the preliminary notification of the Performer by e-mail for 15 calendar
days before the expected date of the cancellation of the Agreement. |

- 3. Prices and settlement of
accounts
|
|
|
3.1. The payment of the service is performed on the basis of the prepayment.
|
|
|
|
3.2. All financial resources, entered to the operating account of the
Performer from the Customer, are transferred to the personal account
of the Customer. The Performer notifies the Customer about entered financial
resources without delay.
|
|
|
|
3.3. The payment of the service is performed over the prices and on
conditions, published at the website.
|
|
|
|
3.4. The Customer has the right to pay for the service by payment systems,
indicated at the website.
|
|
|
|
3.5. If the balance of the Customer is zero, The Performer interrupts
the access to the service.
|
|
|
- 4. Responsibility
|
|
|
4.1. The Performer is not answerable to the Customer and third parties
for: interruption of the service, damage, losses or missed profit.
|
|
|
|
4.2. After the cancellation of the Agreement on the initiative of the
Customer by the reasons, which are not foreseen by the paragraph 2.9.,
the unused part of the prepayment is not returned to the Customer.

|
|
4.3. The Performer reserves the right to cancel the Agreement in absolute
order if the Customer:
- uses the service in any illegitimate objectives
- doesn’t use the service of the Performer for 6 months and more
|
|
|
|
4.4. If the Customer paid for the service without execution of the positive
test call within the network PCTEL, and then couldn’t connect, the financial
resources, credited to the account of the Performer, are not returned
to the Customer..

|
- 5. Disclaimer
|
|
|
5.1. The Performer is not responsible for all losses of the Customer
(financial, time and moral), connected with the suspension of work of
the Performer, nonoperability of the software, loss of the data packet(s)
and so on. The present limitations don’t limit
the consumer rights.
|
|
|
|
5.2. The Performer is fully excused from responsibility in case of appearing
of the circumstances of insuperable force (force majeure), which couldn’t
be foreseen or prevented. Under the circumstances of insuperable force
war and military operations, insurrections, fires, explosions, floods,
natural disasters, which have the effect on the execution of obligations,
are understood.

- 6. Lenth of the agreement
|
|
|
6.1. The present Agreement comes into force from the moment of performing
of the payment by the Customer for the providing of the service.
|
|
|
|
6.2. The Agreement is concluded for the term of 6 months and is prolonged
automatically with the following payments.
